1. Acceptance of Terms

By accessing or using Freddie's services (the "Services"), you agree to be bound by these Terms of Service and any additional terms and conditions that we may provide to you. If you do not agree to these terms, you may not access or use the Services.

2. Eligibility to Use the Services

Freddie is a values-based, membership-based community. Access to the platform and services is by application only and is not guaranteed. Membership approval is discretionary and based on alignment with our mission, values, and community guidelines. We welcome individuals of all ethnicities and backgrounds who align with our values, with a focus on supporting sapphic, trans, and gender-diverse people. We center the experiences of Black, Indigenous, and other people of color (BIPOC), without excluding others.

In addition to meeting our membership criteria, you must:

  • Be at least 18 years of age;

  • Have the legal capacity to agree to these Terms;

To protect our users, we reserve the right to deny or revoke membership at our sole discretion, with or without notice or explanation, including for behavior that we determine may pose a risk to the community or contradict our core values. We will not deny or revoke membership on the basis of race, gender, sexual orientation, disability, religion, or any other legally protected category.

While we do not conduct routine background checks, we may review publicly available information (such as court records, sex offender registries, or news reports) or investigate reports of harmful behavior using our reasonable judgment to assess safety risks. By joining Freddie, you agree that your use of the platform is conditioned upon honest participation and behavior that aligns with our Community Guidelines.

You are solely responsible for your interactions with other users. Freddie makes no guarantees as to the background, character, or intent of any member, and disclaims liability for user conduct both on and off the platform.

3. Intellectual Property Rights

We retain all rights, titles, and interests in and to the Services, Content, and Marks, except for the rights expressly granted to you. Any unauthorized use of our intellectual property is strictly prohibited and will result in termination of access and potential legal action.

4. User Submissions and Contributions

Submissions: By directly sending us questions, suggestions, feedback, or any other materials ("Submissions"), you agree that such submissions become our sole property. You grant us all rights, titles, and interests in the Submissions, and you acknowledge that we may use them for any purpose without acknowledgment, attribution, or compensation to you.

Contributions: The Services may allow you to post, upload, or otherwise share content ("Contributions"), including text, images, video, links, and other materials. By making Contributions on the platform, you grant Freddie a worldwide, royalty-free, non-exclusive, perpetual, and irrevocable license to use, reproduce, adapt, publish, distribute, publicly display, and create derivative works from your Contributions in connection with operating and improving the Services. This license is subject to our Privacy Policy and applicable law.

You represent and warrant that your Contributions:

  • Are original to you or that you have all necessary rights, licenses, and consents to share them;

  • Do not violate any law, regulation, or third-party rights (including intellectual property, privacy, or publicity rights);

  • Do not contain harmful, harassing, defamatory, sexually explicit, or otherwise offensive or inappropriate material.

We reserve the right, but not the obligation, to monitor, remove, or edit any Contributions that violate these Terms, our Community Guidelines, or that we otherwise deem inappropriate, harmful, or objectionable at our sole discretion.

All promotional content must comply with applicable laws and our community standards. We reserve the right to approve or remove promotional content at our discretion.

7. Account Creation Abuse

Freddie monitors for patterns of account creation abuse. Phone numbers associated with repeated deletion and recreation of accounts, or actions intended to evade moderation (such as mutes, blocks, or bans), may be permanently banned from creating new accounts. We reserve the right to permanently ban any phone number, device, or user involved in these activities without notice.

Examples of abuse include:

  • Creating and deleting accounts repeatedly to reset visibility (such as evading mutes).

  • Attempting to manipulate the community experience through serial re-registration.

  • Circumventing enforcement actions taken against prior accounts.

Although we are not obligated to monitor all activity, we reserve the right to review, remove, or edit any user-submitted content. We may also suspend or terminate user accounts for any behavior that violates our Terms or community standards. We also reserve the right to deny, suspend, or revoke memberships if monitoring reveals behavior inconsistent with our Terms, Community Guidelines, or Membership Guidelines. We may also deny, suspend, or revoke membership at our discretion based on monitoring and enforcement actions.

11. Modifications to the Services

To ensure the best possible experience for all users, Freddie reserves the right to require users to update the app at our discretion. Updates may be necessary to maintain the functionality, security, and overall performance of the app. Failure to update may result in restricted access to certain features or app functionalities until the update is completed.

We reserve the right to modify or discontinue the Services at any time, with or without notice. We are not liable to you or any third party for any changes, suspensions, or discontinuations of the Services.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

15. Dispute Resolution and Arbitration

Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will take place in San Francisco, California. You and Freddie agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. By using the Services, you waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions to this arbitration requirement include intellectual property disputes, criminal matters, or claims eligible for small claims court, and small claims matters, which may be handled in appropriate courts with jurisdiction over the matter.

16. Age Restrictions and Safety

Freddie does not allow minors under the age of 18 to use the platform. Additionally, we employ automated systems to monitor and remove harmful content, including CSAM and any material that violates community standards.
